Information on the rules for entry into Hungary due to the COVID-19 epidemic for non-Hungarian citizens

Government Resolution No. 407/2020 on the temporary reintroduction of border control, in force from 1 September to 1 November. and 422/2020. 408/2020 on travel restrictions during the epidemiological preparedness period. amended the conditions for the entry of non-Hungarian citizens into Hungary by a government decree.

A non-Hungarian citizen may not enter the territory of Hungary in passenger traffic - with the exception specified by law or government decree.

Section 6 (1) In the cases specified in subsection (2), the local police body competent according to the place of planned entry into the territory of Hungary, in the case of crossing the border at Budapest Liszt Ferenc International Airport, BRFK XVIII. District Police Headquarters (hereinafter: police body) may grant an exemption upon request.

2. The police authority may, in accordance with paragraph 1, with the exception of paragraph 8, authorize entry if the applicant proves that the purpose of the entry is:

a) participation in a procedural act related to court or official proceedings in Hungary, certified by a document issued by a Hungarian court or authority,

c) access to health care with a referral from a health care institution or other appropriate certificate,

d) fulfillment of an obligation to study or examine on the basis of a student or pupil status, if this is evidenced by a certificate issued by the educational institution,

(e) travel in passenger transport in connection with work in connection with a transport activity, with the aim of arriving at the place of departure of the transport task (place of commencement of work) or returning in person after such work, if evidenced by a certificate issued by the employer,

f) participation in family events (marriage, baptism, funeral),

g) care of a relative in accordance with Act V of 2013 on the Civil Code,

h) Section 6 (1) In the cases specified in subsection (2), the local police body competent according to the place of intended entry into the territory of Hungary, in the case of crossing the border at Budapest Liszt Ferenc International Airport, BRFK XVIII. District Police Headquarters (hereinafter: police body) may grant an exemption upon request.

2. The police authority may, in accordance with paragraph 1, with the exception of paragraph 8, authorize entry if the applicant proves that the purpose of the entry is:

a) participation in a procedural act related to court or official proceedings in Hungary, certified by a document issued by a Hungarian court or authority,

c) access to health care with a referral from a health care institution or other appropriate certificate,

(h) participation in a major church event of international concern; or

(i) a justifiable reason other than points (a) to (h).

(3) An application under paragraph 1

a) may be submitted only electronically, in Hungarian or English,

(b) may also be submitted by a legal representative or by a proxy specified in a power of attorney in a private document of full probative value.

(4) If the entry takes place at the same time and the reason for the entry is the same, an authorized representative may submit an application on behalf of several persons, if the authorization of the persons concerned is attached.

5. In the case of close relatives crossing the border for the same reason and at the same time, it shall be sufficient, for the purposes of paragraph 4, to submit an application in respect of close relatives living in the same household as the applicant.

(6) The application shall indicate the purpose of entry in accordance with paragraph 2, specify the document suitable for the crossing of the state, which is suitable for the identification of the person concerned, shall indicate the identification number of the document and shall be attached to the application.

(a) where possible in the light of the reason for the request, a copy of the document certifying the purpose of the entry in accordance with paragraph 2,

(b) in the case of proceedings by proxy, the power of attorney.

7. An application under paragraph 1 shall be made only

a) an electronic form sent from a company portal or customer portal in the framework of electronic administration,

(b) in the absence of the use of a company gateway or customer gateway, by submitting and submitting an intelligent form available on the police website.

(8) The application shall be rejected by the police authority if

(a) there is doubt as to the purpose of the entry in accordance with paragraph 2,

(b) entry is risky for reasons of (ba) epidemiology, (bb) public security or (bc) national security.

(9) An appeal filed against a decision of a police body shall be adjudicated by the county (capital) police headquarters performing the management of the police body.

§ 7. (1) In order to prove the substantiation of the application, the original copy of the document submitted pursuant to § 6 (2) and § 6 (6) a) (hereinafter: document certifying the substantiation) upon entry into the territory of Hungary shall be a person exempted from the entry ban (hereinafter: licensee) is obliged to present it at the request of the police officer.

(2) If the licensee fails to present the original of the document certifying the substantiation in accordance with paragraph 1, or if its authenticity is in doubt at the time of entry, entry shall be refused.

(3) Upon entering Hungary, the licensee may undergo a medical examination, which he or she is obliged to tolerate,

a) in whom the medical examination reveals a suspicion of infection, may not enter the territory of Hungary,

(b) which is not suspected of being infected during the health inspection, shall be placed in quarantine or official home quarantine designated by the competent epidemiological authority for 10 days.

4. At the request of the quarantined person referred to in paragraph 3 (b), the epidemiological authority competent to issue the quarantine order may authorize the quarantined person, within 5 days, at least 48 hours apart, twice to biological test - SARS-CoV-2 PCR test - to grant an exemption under paragraph 5. By way of derogation from paragraph 1, a person referred to in paragraph 1 may enter the territory of Hungary even if a molecular biological test in accordance with health professional rules has been performed once within 3 days prior to the sporting event, sporting event or cultural event. - SARS-CoV-2 PCR test -

If, in the case referred to in paragraph 4, the two molecular biological tests, the SARS-CoV-2 PCR test, show that the SARS-CoV-2 coronavirus is present in the body of a person quarantined in accordance with paragraph 3 (b) was not detected at the time of the inspection, the quarantine authority shall grant an exemption from the quarantine order issuing the decision ordering the quarantine.

Provisions for business and business travel

10 / B. § (1) If entry into Hungary is an activity for business or economic purposes, the fact of which is proved by a non-Hungarian citizen upon entering the territory of Hungary, he or she may enter the territory of Hungary without restriction.

(2) If, during the entry of a non-Hungarian citizen into Hungary, there is any doubt as to the authenticity of the proof of the reason referred to in subsection (1) upon entry, Articles 5 to 7 shall apply. §.

Rules for admission to sporting events and cultural events

§ 12. (1) The non-Hungarian citizen

a) a participant of an international sporting event held in the territory of Hungary, excluding the spectator,

b) a person with a letter of invitation issued by the official organizer of a sports event to be held in Hungary,

c) at the invitation of a Hungarian sports organization or national sports trade union

ca) a competitor with a competition license,

(cb) a sports professional; and

cc) a person involved in the organization of a sporting event

Except in accordance with paragraph (2), you may enter the territory of Hungary if, within 5 days prior to entry into Hungary, at least 48 hours apart, two molecular biological tests have been performed in accordance with health professional rules - SARS-CoV-2 PCR test - certifies in Hungarian or English that the SARS-CoV-2 coronavirus was not detectable in the body at the time of the study.

d) a cultural event to be held in Hungary

da) his performer,

(db) a member of its technical staff

(2) A person referred to in paragraph (1) may, by way of derogation from paragraph (1), enter the territory of Hungary if, within 3 days prior to the sporting event, sporting event or cultural event, he or she has performed once in accordance with health professional rules, molecular biological test - SARS-CoV-2 PCR test - confirms with a document in Hungarian or English that SARS-CoV-2 coronavirus was not detectable in the body at the time of the test.

12 / A. § (1) The event to be held in Hungary

(a) an international sporting event; and

b) cultural event

spectator (hereinafter together: spectator) may enter the territory of Hungary as specified in paragraphs (2) and (3).

(2) During the spectator's entry into Hungary

(a) may undergo a medical examination to which he is subject,

(b) present a ticket for participation in an international sporting event or cultural event, and

c) certifies in a Hungarian or English language document containing the results of a molecular biological test - SARS-CoV-2 PCR test - performed once in the 3 days prior to entry, in accordance with health professional rules, that the coronavirus SARS-CoV-2 it was not detectable at the time of the study.

(3) A spectator may not enter the territory of Hungary if

(a) a health examination in accordance with paragraph 2 (a) reveals a suspicion of infection,

(b) does not present a participation ticket in accordance with paragraph 2 (b), or

(c) there is doubt as to the authenticity of the participation ticket referred to in paragraph 2 (b).

(4) Pursuant to subsection (1), a person residing in the territory of Hungary is obliged to leave the territory of Hungary within 72 hours after entry.

Rules for persons transiting through Hungary

§ 14. (1) A non-Hungarian citizen coming from abroad may enter the territory of Hungary in passenger traffic for the purpose of transit if he or she submits to a health examination upon entry and the health examination does not establish the suspicion of infection.

(2) An additional condition for entry for the purposes of subsection (1) is that the non-Hungarian citizen coming from abroad

(a) have the entry conditions provided for in the Schengen Borders Code,

(b) provides credible evidence of the purpose of the journey and the country of destination of the journey; and

c) entry into the country of destination and, to this end, entry into a state neighboring Hungary on the route of the planned journey is ensured.

(3) A non-Hungarian citizen entered from abroad arriving pursuant to subsection (1) may travel during the transit through the territory of Hungary only on the route specified pursuant to subsection (5) and, with the exception of subsection (4), only for reasons strictly necessary for transit. Thus, in particular for health or technical reasons, he may stop at the resting places specified in accordance with paragraph 5 and must leave the territory of Hungary within the time specified in paragraph 5, but not exceeding 24 hours.

(4) A non-Hungarian citizen entered from abroad arriving pursuant to subsection (1) may interrupt and stop his / her journey on the specified route in addition to stopping at a rest area specified pursuant to subsection (5) only in a technical or medical emergency requiring immediate intervention.

(5) The National Chief of Police shall determine and publish on the official website of the police the road border crossing points for the entry and exit of transit traffic, the route of through traffic, the rest areas and the time frame available for leaving Hungary.
